Welcome to Drone DMC LLC (“Drone DMC,” “we,” “our,” or “us”). These Terms and Conditions govern your access to and use of dronedmc.com (the “Website”), including any inquiries, communications, booking requests, and services offered through the Website or by phone.

By using this Website or submitting a booking request, you agree to be bound by these Terms and Conditions.

2. Services

Drone DMC provides media-related services, which may include, without limitation:

  • aerial photography

  • aerial videography

  • real estate photography and marketing media

  • 360 virtual tours

  • construction progress documentation

  • editing and post-production

  • related creative and visual media services

All services are subject to availability, project suitability, safety requirements, weather conditions, airspace restrictions, legal compliance, and final approval by Drone DMC.

3. Booking Requests and Scheduling

Submitting a booking request through the Website or by phone does not guarantee an appointment. All bookings are considered requests only until confirmed by Drone DMC.

Drone DMC reserves the right to accept, decline, reschedule, modify, or cancel any requested appointment based on availability, weather, safety concerns, airspace restrictions, project conditions, travel considerations, legal restrictions, or other operational factors.

4. Quotes, Pricing, and Scope

Any pricing shown on the Website is provided for general informational purposes only unless clearly stated otherwise. Final pricing may vary depending on factors including, but not limited to:

  • project scope

  • property size

  • location

  • travel requirements

  • turnaround time

  • editing needs

  • licensing needs

  • weather delays

  • airspace restrictions

  • site access

  • special client requests

Any written quote, confirmation, invoice, proposal, or booking agreement provided by Drone DMC will control over general pricing displayed on the Website.

5. Payments

Payment terms will be communicated at the time of booking confirmation unless otherwise stated in writing. Depending on the type of project, Drone DMC may require advance payment, partial payment, progress payment, or payment upon delivery.

Drone DMC reserves the right to withhold delivery, suspend services, delay licensing rights, or decline future bookings in the event of unpaid balances or late payment.

6. Cancellations and Rescheduling

Clients should provide as much notice as possible if a confirmed booking needs to be canceled or rescheduled.

As a general policy:

  • cancellations made with reasonable advance notice may be rescheduled without penalty, subject to availability

  • short-notice cancellations may be subject to a cancellation fee

  • same-day cancellations may be subject to partial or full charges

  • cancellations made after travel has begun or after on-site arrival may be subject to charges for time, travel, and work already performed

If a site is not ready, accessible, safe, or legally available at the scheduled time, Drone DMC may treat the appointment as a cancellation or reschedule.

7. Weather, Safety, and Flight Conditions

Drone DMC services, especially drone-related services, are subject to weather, lighting, safety conditions, FAA regulations, airspace restrictions, and pilot discretion.

Drone DMC reserves the right to delay, modify, reschedule, or cancel any service if conditions are unsafe, restricted, unlawful, or likely to compromise the quality of the work.

Weather-related rescheduling will generally not be treated as a standard client cancellation when conditions are genuinely unsuitable for safe or lawful operation. Drone DMC will make reasonable efforts to reschedule affected appointments as availability allows.

8. Client Responsibilities

The client is responsible for:

  • providing accurate project and contact information

  • securing necessary permissions, approvals, and access to the site

  • ensuring the location is ready at the scheduled time

  • informing Drone DMC of hazards, restrictions, HOA rules, airspace concerns, or special requirements

  • obtaining permission from owners, tenants, managers, or other relevant parties when needed

Drone DMC is not responsible for delays, reduced coverage, rescheduling, or additional charges caused by inaccurate information, denied access, site unpreparedness, legal restrictions, or unsafe conditions.

9. Deliverables and Turnaround Times

Delivery times may vary based on project scope, editing requirements, weather delays, workload, revision requests, technical issues, and other operational factors.

Any turnaround estimate provided by Drone DMC is made in good faith but is not guaranteed unless expressly confirmed in writing.

Drone DMC retains creative discretion regarding shot selection, composition, editing style, and final deliverables unless specific requirements are agreed to in writing before the project begins.

10. Revisions and Additional Editing

Basic editing is included only to the extent described in the applicable quote, package, or booking agreement.

Additional revisions, advanced retouching, re-edits, custom requests, raw file preparation, or changes outside the agreed scope may incur additional charges.

11. Ownership and Intellectual Property

Unless otherwise stated in a separate written agreement, Drone DMC LLC retains all copyrights, ownership rights, and intellectual property rights in all photos, videos, edits, drone footage, 360 captures, raw files, and related deliverables created during the project.

Upon full payment, the client receives a limited, non-exclusive, non-transferable license to use the final delivered media for the client’s intended business, marketing, promotional, listing, or internal use, subject to any restrictions stated in the applicable agreement.

This license does not transfer copyright ownership.

Any request for the following must be separately negotiated and confirmed in writing:

  • exclusive rights

  • transfer of copyright

  • ownership of raw footage or raw files

  • work-made-for-hire treatment

  • expanded commercial licensing

  • resale or sublicensing rights

12. Portfolio, Promotional, and Marketing Use

Unless otherwise agreed to in writing before the project, Drone DMC may use completed project media for:

  • portfolio display

  • Website content

  • social media

  • marketing materials

  • advertising

  • presentations

  • business development purposes

If a client requires confidentiality, restricted usage, or non-disclosure relating to project media, that must be requested and agreed to in writing before or at the time of booking.

13. Third-Party Platforms and Tools

This Website may include or rely on third-party tools, platforms, embeds, maps, scheduling systems, hosting providers, social media links, media players, or form services.

Drone DMC is not responsible for the availability, content, functionality, privacy practices, or policies of third-party services.

14. Website Use

You agree not to:

  • use the Website for unlawful purposes

  • submit false or misleading information

  • attempt unauthorized access to the Website or its systems

  • interfere with the operation or security of the Website

  • copy, scrape, reproduce, or misuse Website content without permission

  • service-related disputes

  • loss of business opportunity, profits, or data

Drone DMC’s total liability for any claim arising out of or relating to the Website or any service shall not exceed the amount actually paid by the client to Drone DMC for the specific service giving rise to the claim.

17. Indemnification

You agree to indemnify, defend, and hold harmless Drone DMC LLC from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable legal fees, arising out of or related to:

  • your misuse of the Website

  • inaccurate or incomplete project information

  • unauthorized use of deliverables
